In Montana, homeowner associations BOD meetings are required to be open to all homeowners. State laws allow these meetings to be held remotely by teleconference or videoconference, unless the articles of incorporation or bylaws specify otherwise.
Since 2021, Ptarmigan’s BOD have held virtual meetings by Zoom which has provided a better opportunity for the all owners to attend and to comment.
Executive Session
State law also allows for the BOD to go into a closed meeting, where privileged information and private matters may be discussed. These are for BOD members and invitees only, and are currently being held in advance of our Open Sessions.
The following is a standard agenda of topics for discussion during the Executive Session of the BOD Meeting:
• Consultation with Counsel / Status Reports
• Incident Reports / Owner Issues / Violations
• Arrears and/or Liens pending
• Other pre-decisional matters as may be applicable (Insurance, Management, Staff, Equipment, Infrastructure, Contracts/Service Agreements, Easements, etc.)
• Announcements
• Adjourn and reconvene into Regular (Open) Session
After an executive session in Montana, the closed session's minutes are confidential. While an outcome or action may be reportable in open session, the details discussed in executive session to reach that outcome remain protected.
